These Terms of Use ("Terms") govern access to and use of MAYA GROUPE SARL products and services, including MAYA websites, APIs, mobile applications, customer support, administrative tools, and Wigo, our car-sharing and mobility product.
By accessing or using a MAYA product or service, you agree to these Terms. If you do not agree, you must not use the service.
1. Who we are
MAYA GROUPE SARL ("MAYA", "we", "us", or "our") operates mobility, agriculture, and digital products. Wigo is MAYA's car-sharing and car rental product that helps people browse cars, publish car listings, and organize bookings through the Wigo mobile app.
2. Eligibility
You may use MAYA services only if you can legally enter into a binding agreement and comply with these Terms. For Wigo, you must also meet the age, identity, payment, driving license, insurance, and legal eligibility requirements that apply in the country where you use the service.
MAYA may refuse, suspend, or limit access if we believe a user does not meet eligibility requirements, creates safety or fraud risk, violates these Terms, or uses the service unlawfully.
3. Accounts and security
You are responsible for the accuracy of information you provide and for keeping your account credentials secure. You must not share your account, impersonate another person, create false listings, submit false identity or driving information, or use another user's account without permission.
You must notify MAYA promptly if you believe your account has been compromised or used without authorization.
4. Wigo marketplace role
Wigo may allow car owners or authorized hosts to list vehicles and renters to book vehicles. Unless expressly stated otherwise, MAYA provides the technology platform and related support tools. Hosts are responsible for their vehicles, listing accuracy, legal right to list the vehicle, maintenance, safety, required documents, and compliance with applicable law.
Renters and drivers are responsible for using booked vehicles lawfully, carefully, and according to the booking terms, host instructions, and applicable road rules.
5. Listings, bookings, and vehicle information
Hosts must provide accurate and current listing information, including vehicle make, model, year, condition, photos, location, features, price, availability, documents, and any restrictions. MAYA may review, approve, reject, hide, suspend, or remove listings at any time.
Renters should review listing details before booking. Vehicle availability, price, pickup details, and included features may change until a booking is confirmed in the Wigo app.
6. Payments, refunds, and fees
Wigo payments may be processed through third-party payment providers such as Stripe. You agree to pay all applicable booking prices, fees, taxes, penalties, deposits, damage charges, cancellation fees, and other amounts shown or accepted in the service.
Refunds, host payouts, cancellations, disputes, and adjustments may depend on the booking details, product rules shown in the app, payment provider rules, and applicable law. MAYA may delay, cancel, or reverse payments where needed for fraud prevention, chargebacks, errors, safety issues, disputes, or legal compliance.
7. User conduct
You agree not to:
- use the services for unlawful, harmful, fraudulent, abusive, or unsafe activity;
- bypass Wigo payments, booking flows, verification, or safety processes;
- submit false, misleading, offensive, infringing, or illegal content;
- damage, misuse, steal, tamper with, or abandon a vehicle;
- harass, threaten, discriminate against, or abuse another user, driver, host, MAYA staff member, or partner;
- scrape, reverse engineer, overload, probe, attack, or interfere with MAYA systems;
- use the services in a way that violates applicable law, road safety rules, insurance obligations, or these Terms.
8. Content, photos, and reviews
You may submit content such as profile information, vehicle photos, listing details, reviews, messages, and support materials. You keep ownership of your content, but you grant MAYA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, adapt, and use that content as needed to operate, market, secure, and improve the services.
You must have the rights needed to submit your content. MAYA may remove or restrict content that we believe violates these Terms, infringes rights, creates safety risk, or harms trust in the platform.
9. Safety, incidents, and disputes
Users must promptly report accidents, damage, theft, safety incidents, fines, police matters, disputes, or other serious issues related to a Wigo booking. MAYA may request documents, photos, identity details, trip records, payment records, location information, or other evidence to investigate and resolve an issue.
MAYA may cooperate with insurers, payment providers, courts, regulators, law-enforcement authorities, and professional advisers where needed to protect rights, safety, users, vehicles, and the platform.
10. Third-party services
MAYA services may rely on third-party providers for payments, hosting, maps, location search, push notifications, email, analytics, and other operations. Third-party services may have their own terms and privacy notices. MAYA is not responsible for third-party services that we do not control.
11. Intellectual property
MAYA, Wigo, MAYA logos, product names, designs, software, text, graphics, and service content are owned by MAYA or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from MAYA services except as allowed by these Terms or with written permission from MAYA.
12. Privacy
MAYA processes personal data according to the Privacy Policy available on the MAYA website and in applicable products. By using the services, you acknowledge that MAYA may collect, use, share, and retain personal data as described in that policy.
13. Service availability and changes
MAYA may change, suspend, discontinue, or limit any service, feature, listing, account, route, market, or product at any time. We may also update mobile apps, APIs, pricing, service rules, or eligibility requirements.
We try to keep the services reliable, but we do not guarantee uninterrupted, error-free, or always available service.
14. Disclaimers
To the fullest extent permitted by law, MAYA services are provided "as is" and "as available". MAYA does not guarantee that listings, vehicles, hosts, renters, drivers, prices, availability, locations, photos, reviews, or third-party services will always be accurate, complete, safe, available, or suitable for a particular purpose.
Nothing in these Terms excludes rights or warranties that cannot be excluded under applicable law.
15. Limitation of liability
To the fullest extent permitted by law, MAYA is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, vehicle downtime, or business interruption arising from or related to the services.
Where liability cannot be excluded, MAYA's liability will be limited to the maximum extent permitted by applicable law.
16. Indemnity
You agree to protect and compensate MAYA, its directors, employees, contractors, partners, and affiliates from claims, losses, liabilities, damages, fines, penalties, costs, and expenses arising from your violation of these Terms, misuse of the services, unlawful activity, content, bookings, vehicle use, or infringement of another person's rights.
17. Termination
You may stop using the services at any time. MAYA may suspend, restrict, or terminate access to an account, listing, booking, feature, or product if we believe it is necessary to protect users, vehicles, MAYA, partners, or the public, or if a user violates these Terms or applicable law.
Sections that by their nature should survive termination will continue to apply, including payment obligations, intellectual property, privacy, disclaimers, liability limits, indemnity, and dispute-related provisions.
18. Governing law and disputes
These Terms are governed by the laws applicable where MAYA GROUPE SARL is registered, unless mandatory local consumer or mobility laws require a different rule. Users and MAYA should first try to resolve disputes in good faith through the support or contact channels made available by MAYA.
19. Changes to these Terms
MAYA may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify users, such as updating the date above, publishing the updated Terms, or sending an in-product notice where appropriate.
Continued use of the services after updated Terms become effective means you accept the updated Terms.
